Hi all

is this the right legislation to be reading?

https://www.legislation.gov.uk/uksi/2007/3483/regulation/10/made

I have a PCN from 2018 that I have recently received another reminder and further debt collection letter.

The original notice to keeper was sent 32 days after the date on which the contravention took place.

I am just trying to find out where I stand with regards to the length of time it was taken to send out.

Thanks

That relates to council parking tickets.

Can you tell us which parking firm?  As far as debt collectors are concerned (if chasing a basic PPC charge), just ignore them. The NEWBIES FAQ Announcement, fourth post, tells you why.

When the NtK was served is now irrelevant, given the charge is from 2018, unless/until it gets to a court case, at which point it may have some minor legs.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

This is already covered in the NEWBIES thread, with a link to Schedule 4 POFA 2012.

    It is Met Parking Services.

I have read the newbies thread and found the info on POFA.

I am trying to determine whether I would have a case at court as the NTK sent was dates 32 days after the event.

I have been to court before for a PCN.

MET hardly ever issue court proceedings.

Thought as much due to time involved but I am quite inquisitive and just wanted to weight up the probability given the NTK was issued 32 days after. My assumption is that they probably won’t bother but I wanted to make sure my understanding was correct.

    Was it a windscreen ticket?

You know from the PoFA schedule 4 (linked in the NEWBIES thread) what the deadline is, depending on whether there was a windscreen PCN first.

AND that it's not just about the date of NTK, it's about the wording too.

As the NEWBIES thread fully explains.

As I said I wanted to make sure. Interpretation is key.
