Disability child element universal credit

I have recently found out that I should have been receiving the higher amount off child disability payment on my universal credit since 2019.
I've spoke to citizens advice and they have said I should have reported the change but to try and get it backdated.
When i made the claim my son was in the process off changing from dla to pip as he was over 16. When I have made ny claim to universal credit he was on low rate care, a few months later he was awarded enhanced pip, I was unaware I had to tell them off the change as he was still on disability benefits and they were aware off this. I never even knew there was 2 amounts.
Is there any hope I'm me pursuing this and taking it to tribunal? The amount totals nearly £14000
Any help and advice is appreciated

  • Also i would have thought as it is the dwp who also pay my sons pip they would have known off the change off rate dla to pip etc

    You'd have thought so but no, different DWP departments don't talk each other.  They each have separate systems.

    You will need to report the changes but usually they will only add the extra from the assessment period in which the changes were reported. It will be down to a decision maker to decide when to backdate it to.
    When claiming UC it's your responsibility to report all changes. 
    Considering it's been 3 years are you still claiming the child element for your son?

    If they did allow it you would only receive the difference between the lower and higher rate, you won't be entitled to both elements.
