Avro to Octopus price cap

I was forced onto an Octopus tariff when Avro when under, onto the flexible avro October 2021.
The rate remained competitive so did t change.
I have revised my post October 22 bill and they have set my electric at 50.63p per KWHr. Should this not be covered by the government 35p price cap? This is a similar story for my gas.
