Parking eye parking fine

Hi I've just received a fine from parking eye. I am a new member of the gym (my second time at the gym) and it gives me 3hrs free parking. However the sign which I didn't see said that for members at the gym you must register your car plate at reception to get 3hrs free parking which I did not see. When I got to the gym all i did was scan the barcode to get me into the gym and didn't notice the tablet that lets you key in your car reg. When you do scan the barcode to gain access to the gym it saves the time as a reciept on the app on my phone. Parking eye used a automatic number plate system to catch my car coming in and out and clocked me for 3hrs and 3 minutes. Do you know what i should do next as I think it's unfair as i did sign in from the app which produces the time that I got into the gym but I just didn't register my car reg and the 3 minutes over does seem harsh to me.

    It's not a fine!
They have not caught you for 3 minutes over they have done you for not entering your VRN but as a new member you should have been informed of the terms and conditions of parking and the procedure should be clearly displayed on entry it obviously was not.
You should now firmly inform the management that you consider them at fault and that they should get their contractor to cancel this invoice or you will be cancelling your membership.

I have also got another fine in the same place one week apart. One for over staying for 3hrs 3 minutes and other is 3hrs 32 minutes.
I have not wrote a complaint letter before so I would like it if you could review this please. Im not sure who I should be complaining to but this is a email I will be sending to the gym.

    Dear sir/madam

I am writing to you as I am a new member at your gym. I have gotten two parking fine as I thought that the gym members got free parking so i over stayed. This is my 3rd time coming to your gym. In a space of once a week. I did not know that it was free for only for 3hrs and you have to key in your registration at reception. The signage outside was unclear and only noticed when I got 2 invoices in the post asking for money. There was nothing on display to tell me i had to key in my registration in the gym and no one informed me either at reception. And it did not specify that the time starts as soon as you enter the car park and it took me quite a while to find a parking space on these separate occasions as no parking spaces were available at the time of entrance. I consider you as fault. As a new member I was not informed of these requirements. Please can you get your contractors to cancel these parking invoices as I would hate to be penalised for this and ruining my Christmas for me and my children as the money that your contractors are asking for are for their presents.

    Dear Sir/Madam

I am writing to you as I am a new member at your gym. I have gotten received two parking fine speculative invoices from your car park management company as I thought that the gym members have free parking so i over stayed. This is my 3rd time coming to your gym but I did not know that it was free for only for 3hrs and you have to key in your registration at reception. The signage outside was unclear and only noticed when I got 2 invoices in the post asking for money. There was nothing on display to tell me i had to key in my registration in the gym and no one informed me either at reception, which is a failing of your induction process. And it did not There was no signage or instruction that specify that the time starts as soon as you enter the car park and it took me quite a while to find a parking space on these separate occasions as no parking spaces were available at the time of entrance. I consider you as at fault.  As a new member I was not informed of these requirements. Based on these points, can you please can you get instruct your contractors to cancel these parking invoices as I would hate to be penalised for this and ruining my Christmas for me and my children as the money that your contractors are asking for are for their presents.
I would write to the General Manager of the gym.  They are not fines.  The gym won't be concerned about your children not receiving presents.

How will they know who the complaint has come from if you withhold your name?  Give them the PE invoice numbers so if the gym can get the charges cancelled they have the references to hand rather than have to come back to you for them. It's important to act swiftly with PE.

You have to give them both PCN numbers, if you are asking them to step in and cancel them.

And of course your name and gym membership number.

I would end the email by saying that this experience has made you question remaining a gym member, because the parking firm has clearly set up a complicated and badly-signed system to penalise gym members.  Even once the system is known, in this time of huge roses in living expenses, who in their right mind wants to have to risk £100 charge every time they use a gym, and fearing making a typo on the keypad at each and every visit? The system will drive members away.

Golden rule of the forum - don't jump in on someone else's thread, confusion and potentially expensive results emanate from it.

In Scotland, complain to the landowner, never reveal the name of the driver (not this side of late 2023 when things could potentially change north of the border), then ignore anything further from PE short of an unlikely claim in the Sheriff Court from them - look out for the Tooth Fairy, Puff the Magic Dragon, the Easter Bunny and Father Christmas coming around for tea at yours if they do!

    Sleep easy.
