New Build House Purchase

Hi all,
I am purchasing a new build house. The house is 99% finished & from what I understand, an CML has been issued. The builder is pushing to issue notice of completion, however my solicitor is advising we cannot complete until we have received the Building Regulation Certificate.
The builder is advising it could take up 2-3 weeks to receive the Building Regulation Certificate, (currently with the Council to issue), but it is not the standard process to wait until this document has been received & an CML should be sufficient to complete.
Our solicitor is advising we cannot proceed without the Building Regulation Certificate & the lender will not release the funds without this.
I am stuck in the middle trying to resolve, not familiar with the process & both parties think they are correct. Any help or information on the 'standard' process would be appreciated.

Your builder is unlikely to find another buyer within 2/3 weeks so he might as well be patient. In any case the house needs to be finished as it is not yet ready to be handed over to the buyer.. Your solicitor acts in your best interests, your vendor (builder) or their agent doesn't.If you are querying your Council Tax band would you please state whether you are in England, Scotland or Wales1

Tell the builder it is simply out of your hands as the lender will not release the funds until the BRC is issued. As lincroft1710 says, who else is he going to sell it to more quickly than you.0

Your not stuck in the middle without the BRC your lender will not release funds so you can not buy it.
This is a fact and not a point of debate. Put this in writing to the builder.0
