TERMS AND CONDITIONS for “Matilda – nominate a teacher – on-air” (the “Competition”).

 

These terms and conditions (the “Specific Terms”) for the Competition should be read alongside  our general competition terms and conditions at: http://www.bauerlegal.co.uk/radio-competition-terms.html (the “General Terms”) which will also apply to this Competition. Where there is any conflict between these Specific Terms and the General Terms, the Specific Terms shall prevail. 

 

1.Entry ROUTES and Costs	Entries to the Competition are restricted to one entry per person. Entry to the Competition is free and is available via https://planetradio.co.uk/magic/competitions/ (“Competition Website”)
2.COMPETITION MECHANIC AND HOW TO WIN	In order to be eligible to win the Competition, each entrant (or person with parental responsibility in the event of an entrant under the age of 18) (the “Nominator”) must go to the Competition Website during the Entry Period (defined below) and provide the following details:  their full name and contact details; the full name of the Nominated Teacher (defined below) the full name of the school where the Nominated Teacher is employed (the “School”); and the reason for the nomination and why the teacher deserves to win. The Nominated Teacher must be a teacher at the primary or secondary school at which the entrant is currently enrolled. The Nominator must obtain consent from the teacher they are nominating (the “Nominated Teacher”) to share their full name and the name of the School with Bauer Radio Limited (“Prize Provider”) for the purposes of this competition prior to submitting their entry. An entry will be deemed invalid if the Nominator does not successfully complete the online entry form with a minimum of 30 words and a maximum of 250 words. Entries will be judged by a panel made of members of the Prize Provider’s production team and an independent judge (the “Panel”). The winning entry will be judged on the following criteria: how compelling the entry story is; and the most deserving story, and the Panel’s decision is final. There will be five winning entries in total. Each winning entry will be selected once the Competition’s entry period has closed. In respect of each winning entry, the Nominator, the Nominated Teacher and their School will be contacted by a member of Prize Provider’s production team before the winning entries are announced. For the avoidance of doubt, no call received by a Nominator, School or Nominated Teacher from the Prize Provider’s production team will deem an entrant a winner of the Competition, the entrant will only win on being told they are a winner by the Prize Provider production team. The Nominated Teacher of each winning entry and their School (together, each a “Winner”) will be notified that they have won no later than 11:59 pm on 16 November 2022. An on-air segment will be recorded with the Nominated Teacher of each winning entry at their School at 9:30 am on a day allocated to them by the Prize Provider’s production team (the “Outside Broadcast”). For the avoidance of doubt, if a Winner is unable to accommodate the Outside Broadcast on the date allocated to them by the Prize Provider’s production team their entry will be invalidated, and the Prize may be awarded to a new Winner, which may take place at a time and date later than those specified above, or may not be awarded. For the avoidance of doubt, in order for the Prize to be awarded, each Winner will need to consent to: the Outside Broadcast; the Outside Broadcast of each winning entry being played live (or as live if pre-recorded) on-air between Monday 21st November until Friday 25th November 2022 during the Magic Breakfast show between 06:00 am – 10:00 am; the last name of the Nominated Teacher, the Nominated Teacher’s hometown, and the School’s name being announced on the air between Monday 21st November and Friday 25 November 2022 on the Magic Breakfast show between 06:00 am – 10:00 am; and any further terms and conditions relating to the Outside Broadcast as may be provided to the School and/or the Nominated Teacher by us in advance. In the event that a Winner fails to provide the relevant consents and permissions as set out in these Specific Terms or as otherwise made available at a later date, the relevant entry will be invalidated, and the Prize may be awarded to a new Winner, which may take place at a time and date later than those specified above, or may not be awarded.
3. ENTRY PERIOD	Entries must be submitted during the following entry period: from 00:01 am on Monday 31st October 2022 (“Start Date”) to 11:59 pm on Sunday 13th November 2022 (“End Date”); and entries received before the Start Date or after the End Date will be invalid.
4. ENTRY RESTRICTIONS	Entry is only open to people who reside in England and are currently enrolled at a primary or secondary school located in England. All entries by persons aged less than 18 years old on the date of entry (a ‘Minor’) must be made on their behalf by a person over the age 18 years with parental responsibility for the Minor. The Nominator must consent to the first name of the entrant being announced on the air between Monday 21st November and Friday 25 November 2022 on the Magic Breakfast show between 06:00 am – 10:00 am, otherwise, the relevant entry will be invalidated. Our employees (and their family members) or employees of any company involved in the Competition, including any Prize Provider, are not permitted to enter. We reserve the right to disqualify any entrant or Winner who does not comply with any of the eligibility criteria and/or is in breach of these Specific Terms. We reserve the right to repeat the competition mechanic or any stage of it in order to select a Winner that fulfils all of the eligibility criteria and is in compliance with these Specific Terms. If you or any other person at your household has won a prize valued at £500 or more on any Bauer Media brand in the past 6 months, you nor they are not eligible to enter or win this competition. 5. THE PRIZE	The following prize will be awarded to each winning entry: the School of the Nominated Teacher will be awarded £2,000 provided by way of BACS payment to the bank account of the School (the “School Prize”); and Prize Provider reserves the right (at its entire discretion) to award any additional prize that it deems appropriate to the Nominated Teacher (the “Teacher Prize” and together with the School Prize the “Prize”). There will be 5 winning entries and five Prizes in total. The Prizes are supplied by Prize Provider. Prizes are non-transferable, non-refundable and where a non-cash prize is awarded no cash alternative will be offered. For the avoidance of doubt, the Nominator will not receive any element of the Prize, or any other prize for themselves.

1. DATA PROTECTION

 

Names, email addresses, and /or telephone numbers (which, for all SMS competitions, will be shared with our SMS provider) will be collected and used to process entries. Winner’s details may be given to a Prize Provider to arrange delivery of the prize.  Your details may remain stored after the End Date but will not be used for marketing unless you have ticked an opt-in box on entry. For SMS entries you automatically consent to receive marketing. You may opt out at any time by texting the word STOP to the relevant text shortcode number. 1. INTELLECTUAL PROPERTY AND CONSENTS

 

By entering this Competition, you are consenting to our use of your entry both to publicise this Competition, our radio station or any other radio station which we own or control. This means that we may use all names, images, descriptions, photographs video footage, and other information, which you have submitted on entry, in any media, without paying you any remuneration therefore and without any time restriction. You also agree that we may film, record or photograph you in connection with the competition and /or the Prize if applicable. We will own these films, recordings or photographs and we may use them publicly, including on the internet, for our radio broadcasts and/or for any promotional purposes. You will also have waived any moral rights or right to payment that you may have had.

 

1. MISCELLANEOUS

 

• Entries which do not comply with these Specific Terms or the General Terms will not be accepted and any entries may be disqualified if we have any reason to suspect that there is a breach of, or non-compliance with, these Specific Terms or the General Terms.
• Where a competition mechanic involves the answering of questions, the correct answers to questions must match our answers to win (or be sufficiently close in our sole reasonable opinion) to be acceptable. In the event of any dispute about any answers given and whether they are correct, we reserve the right to amend what we deem a correct answer, however we are not obliged to, and our decision in either case is final and no correspondence will be entered into.
• We are not responsible if you fail to get through when you call / text to enter, or if you lose signal during a call.
• You are responsible for all costs of entry and where necessary, obtaining the bill payer’s permission. Please refer to your tariff with your network provider for information about charges you may incur for entry into our competitions via any SMS or phone call entry route.
• We accept no liability for network, technical or signal errors, issues or failures experienced by entrants when entering the competition or at any stage during the mechanic of the competition.
• Whilst on-air, you must not make any inappropriate, profane, indecent, harmful or offensive statements. If you do so we reserve the right to take you off-air immediately and disqualify you from the competition. You may be also disqualified from the competition at any time if you are incomprehensible, inaudible or if you appear to be driving, intoxicated or likely to offend listeners. Any prize already won may be withdrawn and re-awarded to another entrant.
• As far as it is lawful to do so we exclude our liability for any losses suffered in connection with the Competition or any element of the Prize.
