PCN UKCPS (NTK) for 8 minutes

First of all, thank you for keeping this forum up and running and helping many of us who needs it at times.

 

I need your urgent help please:

I received a PCN from UKCPS by post. It's received in time (within 14 days), but I opened the letter late and then realised it was a PCN (Today). They have sent NTK. I went onto their website where I can see their photos of vehicle parked for 8 minutes. The driver had to take an urgent call so stayed there for 8 minutes only and left. The call was received when driving so quickly found a safe place to stop, take the call and leave immediately.

 

From the moment driver received the call and safely stopped to talk, there were no visible from the level of the driver, signs of parking or anything similar.

 

I have been on the site myself to check and can confirm that there were few signs but from the level of the driver’s eyes, hard to see or notice especially when trying to respond to an urgent call.

 

The parking site suggests that it’s only for “registered virtual permit holders only” but if someone must stop in the emergency, there is no way to pay or contact with the owner or ukcps for that.

 

I have gone through the Newbies thread and checked the appeal template, but I did not find it useful in this case as what the template says and asks for, does not apply to this case.

 

For example –

“require an explanation of the allegation and your evidence.” – They have already provided their explanation and evidence with the pictures of car being at one spot for 8 minutes.

 

“You must include a close up actual photograph of the sign you contend was at the location on the material date as well as your images of the vehicle.” – They have provided images of vehicle but not the sign.

 

PDT is not applicable as they don’t use that.

 

Does the driver need to pay for less than a 10 minute stay? The driver couldn’t find or see anything or anywhere to pay either?

 

Could you please help me appeal this PCN as I only have 3 days left to appeal on this one?

    I really don't understand why you don't just send the blue text template appeal that you have already found.

    For one thing, it shows the parking company where you are getting help.

    What's all the talk about having to answer an urgent phone call?
    No call is that urgent that you can't find a safe place to park before answering.
    What's wrong with stopping on a road to answer a phone?

    The keeper of the vehicle should send the template appeal.

    I am the keeper and will be doing the appeal (I will just use the template with blue text now). They have provided the images and details on their appeal page so thought of checking first before sending the template text.

    On the answering urgent call - as per the driver, they were passing through that spot to go to the train station where they got the call so the nearest safe place was that spot. It's not actually a road but back off some offices and pass through for a car park or to go to train station area plus some back space of bars and other shops.

    Not sure why you want to appeal?  This isn't urgent; no rush at all, it's daft old ex-clampers UKCPS who can be ignored. You can't win an appeal v an IPC firm because the system is considered bent. Right-thinking people and MPs call it a kangaroo court.

    Try it (FIRST APPEAL ONLY, NOT IAS) but then ignore them.

    Have you searched the forum for UKCPS?  Loads of threads like yours, all cheerfully ignoring UKCPS.  No biggie!
