Existing unsatisfied ccj from 2020 - now Letter from Empira

Hi Everyone,

So EMPIRA sent a letter for a for an existing ccj (unsatisfied) on my credit report that was issued in 2020. Its for £270

Now a letter arrived saying:

You have been sent this notice as you have an unpaid ccj. Your case has been referred to us by our client. They have instructed us to enforce the debt against you unless it is settled in full within 14 days or agree a payment plan.

County court warrant or control

attachment of earning order

info order

I can scan the letter later to this thread if that helps.

How do I tackle this anyone? The damage is done as its on my credit file already.

Thanks to everyone.

How many of these things do you have?  Is this anything to do with any of your other cases you've opened threads for previously?  Who is the claimant for whom this judgment has been made?
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

    Hi Umkomaas,

Thanks for your reply, my credit report has 2 unsatisfied ccjs issued on 2020. I was told as its over 2 years old and under £1000 the damage is already done.

This thread/case is from UK Car Park Management Limited - a parking ticket in 2018 for £188 - Then gladstone solicitors took the case - Now its passed to Empira.

The judgement has already been made - its made by UKCPM

    Thank you

As bailiff/enforcement agent action is seemingly underway, this is now beyond the scope of this forum.

You will be best served in dealing with bailiffs/enforcement agents by making contact with 'Bailiff Advice Online'. Sheila, who provides this service, has an extremely good reputation for assisting people with bailiff issues.

Calls and the email enquiry service are free.

Hi Umkomaas, will they send bailiffs? It says at the bottom of the letter further enforcement action may now be taken without notice

Does anyone know when the bailiffs will arrive?

    Thank you.

Hi Grizebeck, nice to meet you, thanks for your input. Please explain more. I have never heard of Empira until today. As mentioned the ccj is over 2 years old so the cheek of them to now harass for money when we are in a recession and working hard.

Mass litigators like Gladstone's/DCB (for parking firms )don't use bailiffs for enforcement nor do they use things like attachment of earnings orders, third party debt orders (garshee orders) /oral questioning etc (order to obtain information)

Now debts for over £600 are more likely to see
High Court Writ (HCEO) because its a relatively cheap process and the results are better as a terms of % recovered  It isn't financially worth it for the single ticket cases to "enforce"

Now for small businesses/individuals  they are much likely to try and enforce via the way of a county court bailiff

the letter you have got is just there to scare you as it simply isn't the business model of parking firms to act as the way they are claiming so it can be safely ignored. (as the rate of return for "claimed actions" is not worth it for the cost involved

Even for larger debts where a High Court Writ has failed to work they wont then go down the route of attachment for earnings or such like.
