Damage to property by DHL

Hello,
I had a parcel delivered by DHL and left at the rear of my property while I was out. When I returned home, I went to collect it and the gate to the back was open and the fence had been split/had a chunk knocked off the end where the gate has been forced open and the latch has caught it. I reported this to DHL immediately and sent photos of the damage. They've said the driver denies it and are now asking for CCTV, which I don't have, so it seems like they will likely fob me off. Where do I stand if they do?
Thanks

Driver has denied it and you have no evidence they caused the damage. That's where you stand with the cost to repair the damage.mystrywhtby said:Hello,

Without proof of who did it you cannot pursue anybody.1

Thanks.Yeah, I figured as much - it's obvious the driver's caused the damage as there was none prior to this and no-one else would've been through that gate on the same day but i've only got the photos of it after.0

What's the likely cost of repair? Does it actually need repairing or is it just cosmetic damage?
Assuming it does require a repair, and isn't a trivial sum to repair it, there's no harm in sending a letter asking for payment. They may simply send a cheque. If they don't, then there's nothing you can do.0 -
Ultimately it would be a civil case decided on the balance of probabilities (not beyond reasonable doubt), so it's possible a court might agree they're liable. Is it worthwhile pursuing though?0

Was gate locked & delivery guy forced it open, or unlocked. In which case may not have shut fully & wind has blown it about causing damage?mystrywhtby said:Hello,

Then you can't prove it, so honestly it's not worth the effort.mystrywhtby said:Thanks.Yeah, I figured as much - it's obvious the driver's caused the damage as there was none prior to this and no-one else would've been through that gate on the same day but i've only got the photos of it after.
I'd invest in some CCTV - it's more than paid for itself here with this kind of issue.0
