Hawes & Curtis Return Policy

I bought a suit in the sale from Hawes & Curtis and on receiving them found the trousers too small and returned them the next day asking for a refund. I purchased the larger size as I needed them for an event and wasn't sure if the return/exchange would be processed in time. That was a little over a week ago and I have heard nothing nor had a refund since then.
Out of curiosity I went to their website to check the return T&Cs and found an interesting section around sale items:

Clearance and Sale Items
Exchanges are possible within 14 days. Refunds are not possible for Clearance and sale items.
As far as I understood the distance selling regulations it makes no distinction at all whether an item is full or regular price, you are entitled to a refund within 14 days regardless. Have I interpreted this wrong and I am not entitled to any money back from H&C or are their T&Cs blatantly illegal?

Distance Selling Regs got replaced by the Consumer Contracts Regulations
T&Cs cannot override most of your statutory rights and so its more relevant if they actually refund or not rather than what their T&Cs say... in fact on their Returns homepage reconfirms that their T&Cs wont overrule your statutory rights.
You are right in saying that for off premises sales there is no exception for sale or clearance items.1
