  • The questions you were asked that you mentioned above are definitely not just related to someone with physical health conditions, which has been advised.
    I understand the reasons why you asked for help filling out the forms but you should never sign anything without reading it through first.
    As it's UC if you have a journal once the decision is made the letter will be uploaded onto there. Sometimes decisions for WCA for UC are made within a few days, sometimes a week and sometimes longer.
    You're starting to sound like my brother, but I'm guessing you are much prettier (he's not a pretty face :D:smiley: ). He said the same thing just this morning. More fool me, I guess. It is what it is and what will be will be. The quicker it's finished the better, coz I really can't be arsed with it. Leave me alone. Is that too much to ask?

    Ah... sadly you seem very poorly placed to deal with the claim both emotionally and practically.... and why the system needs reform as it fails the very people who almost by definition should qualify.

    3rd party help can be invaluable but I do fear lack of knowledge, preparation and your illnesses have left you potentially at risk of  an inaccurate assessment and it sounds like you might have a raft of evidence to support your claim that may never be seen in the process. Assume the DWP takes a 'path of least resistance' and seeks only the evidence simple and sufficient for them to take a specific decision on the benefit.

    You could ask for the report from the DWP as usually they just rubber stamp the report they commission... and so you can get advance knowledge of likely decision... however it seems possible you may not even be well situated to understand the report in relation to benefit qualification no matter how good or bad it is.

    Should you get a decision you disagree with you can ask them to reconsider and then can pursue independent tribunal if still unsatisfied. If you are found to have limited capability for work and/or work related activity then it can have financial and responsibility (what you do or do not have to do to seek work) consequences for the Universal Credit claim.

    I'm hoping a good decision is reached in this case and yes obviously reading (and understanding) documents is highly preferential to the alternative... in this case not least because the assessment you had essentially will have covered the activities and your problems that were documented in the form and your illnesses would indeed potentially affect the activities they asked you about.

    Also would obviously strongly advise you keep a copy and record of anything you place into the process like the returned signed form.

    I don't know if it's possible to get a copy of the Work Capability Assessment report in advance of a decision. Regardless, a decision is usually made quite quickly so it's possible that there wouldn't be enough time anyway to get a copy of the report prior to a decision being made.

    I've had copies of my reports for ESA a couple of times.
  • I received a copy of my report (UC) before the decision letter was uploaded - I remember being very impressed with the report but still anxious that they'd find an excuse to make a different decision, until I got confirmation in the decision letter.  But I am aware my entire experience was likely not very typical overall.
