Almost £8k owed - chargeback or section 75?

Options
Hi, I ordered a new conservatory with a total cost of £22k and sensibly paid the deposit of 8k via credit card in May 22

The business no longer has a website, FB page and their rating has been removed from checkatrade from 1st Oct 22. I contacted the credit card as it seems like they've either done a running or gone into adminiyetc. Would this be a charge back or section 75?

I have to say the credit card company have already credited the amount to my account but sent a letter saying you can't withdraw it for a period of time. Is this normal?

Thanks in advance

Your card company will prefer chargeback as that would come out of the merchant's bank's pockets rather than theirs, and if they've already refunded provisionally then that sounds like what they've done, as a s75 refund would be irreversible.

Thanks for your input, much appreciated. Must try harder to find a better company next time - thought this one was good with 18 years trading and over 1500 feedback in checkatrade

Chargeback is quicker, easier and it doesnt come from your bank's pocket

Most banks dont actually give you a choice, you raise "a dispute" and the bank decides which of the two mechanisms to use and given S75 is paid from their own pocket there is no surprise which they favour too if you are within the scheme rules.
  • Thanks for your comments - does this mean that it’s been decided or that they are still looking into it?
    cheers

No. Retailer has 45 days to contest. But it can take longer for your CC to tell you they have rejected the chargeback. If it is rejected, they should then move onto a S75 claim.

If it was a S75 claim the letter would have said full & final settlement.

    So presumably this company https://find-and-update.company-information.service.gov.uk/company/07723449

Unfortunately Companies House can lag a little bit so all looks ok at the moment but if its just got into trouble the gazette posting etc may not have made it on there yet but a quick look on the gazette doesnt show anything beyond the business as usual filings.

What type of credit card was it?
I ask as I think there might be a difference if it's amex e.g. a 20 day appeal period.

Amex has a 20 day limit for disputes on chargeback yes, 45 days for the other 2
