Premier Parking Enforcement

Hi, 

Back in May I was given a charge from a private company for parking on private land. I know this was a while ago and I unfortunately followed several people's poor advice to ignore it as the company have no rights. 

Well now Gladstone are threatening me with a letter before claim for £170 or face a CCJ. I just want to know if I have a claim or if I should pay it .

I know there is a lot of information on here but like my name states, I'm a dumbass. I am struggling to work out which path is right for me.

So they booked me after 7 mins of parking and I only noticed it was private parking after this as the signage is not visible from where I parked. I assumed the car park was part of the bank which I was at but I now know it's not. If anyone can help me and just tell me if I'm the knob or not that would be great.  I have until the 28th Oct.

    It would help to have more detail. i.e. which PPC, what exactly it says you are "guilty" of , where it is and so on. However, from what you say there seem to be at least two grounds to defend on : -  poor signage and lack of consideration period.

    Read up on the newbies. If what you have is a Letter before Claim, then standard advice is SAR to parking company, and 30 day debt advice hold email to the solicitors

    From the entrance it is difficult to see any signs about parking...

    Somewhat ironic that there is a company there called WeMakeSigns.  ;)

    I requested a SAR and they have responded which I'm surprised by. I will send the proof of ID to them and see what evidence they have. Thank you for all commenting and sorry for the delay. 
  • Hi, so they have gotten back to me and provided their evidence of my car parked. I'm not sure what I'm meant to do now? I'm trying to read through everything on the main pages but I'm confused easily.
  • Also want to add that sent my proof for the SAR on the 26th Oct and they replied yesterday 7th Dec.

    The smaller sign appears identical to the one at the other end of the car park which states

    "Private Car Park
    Vehicles parked
     at owners risk"

    You should easily win on signage.

  • I'd definitely challenge this. The sign is not viewable on entry, it's tucked up high out of the way and it's too high up to read the small-print let alone see it from a vehicle!  It doesn't meet BPAs CoP re: signage (I imagine IPCs code is pretty much the same). The sign is not illuminated so even more useless at night, dusk or a wet dull day.

    I would firstly challenge this by appealing to the Popla and then wait to see if they take it to court (where  you have a good case) should popla decide to act corruptly and ignore the evidence as they sometimes like to do when tipping the power balance in their ATAs member's favour.
