Will changing

My husband and I had a will written up which including his children from a previous marriage through a solicitor and has since changed it and taken them out of it and they sent a new will with the changes on it. But it hasn't been witnessed by anyone only the solicitor knows about it is that ok ?. My hubby says it's fine but im not sure ? Thanks Mrs Boot

    Have I understood:
    You and your husband had Mirror wills? You don't both share one will so this is how I'm interpreting
    You both made new wills, or only one of you?
    The new will(s) have not yet been signed and witnessed?

    If this is the case the new will(s) are not valid and the older ones stand.
    Could it be that your husband does not actually want the changes which dis-inherit his (other) children?

    The newest will needs witnessing otherwise it's not valid

  • Has you husband already signed it? If so he needs a fresh copy that he can sign in the presence of 2 witnesses otherwise even witnesses it will be invalid and any challenge is likely to be successful.

    And if your husband doesn't believe us or you, ask him to check with the solicitor "Just to put my mind at rest".

    Do you mean it was witnessed and signed by the solicitor and A.N.Other?

    My dad's will was witnessed by a solicitor from the company that produced it, alongside one of their junior assistants.

    If it's been witnessed properly - it's fine.
