Community infrastructure levy.

I am selling a house that I  purchased in 2009 . The buyers solicitors have asked if I have had to pay this . In the property register it states initially there was a levy of £1 a year. I have never had any demands for payment . Will it still be payable ? They are asking me for a document to prove that it is not payable . Can anyone advise please .

    Just state that it has never been paid or demanded and you have no further documentation.

    The answer is obviously no if you haven't ever paid it, but I suspect you're looking at the wrong thing - what exactly does it say in the property register? 
  • Are you the builder?  The CIL on our estate was payable by the developer, not ongoing for the owners to pay.

    No we aren't the builder. No-one else in the area pays this . Ive had to contact the council's legal department with a hope of getting written confirmation from them that the owners are not liable to pay this levy to satisfy the buyers solicitors.

    Why isn't your solicitor sorting this out? You're paying them to do the running around and advice.
  • CIL or Community Infrastructure Levy is payable on new planning permissions where your LPA adopted CIL prior to the planning bring granted. It should have been paid by the developer but if not reverts to the land owner. Your purchase predates CIL (04/2010) and so shouldn't apply unless you have undertaken any extension or annex since owning - again only if the LPA has adopted CIL before any permission. It should only be added to the register of charges if there was a self build exemption (which potentially has a 3 year clawback) or non payment. Both of which you LPA would be able to clarify and confirm if registered in error. £1 would seem incongruent with CIL so possibly a system or admin. error.
