FIRST CHOICE automatic charge for currency buy back guarantee - REQUIRED OR NOT!!!!

For a recent holiday I needed to change £1200.00 into euros at the last minute and chose FIRST CHOICE HOLIDAYS who seemed to offering the best rate locally. After the holiday I was checking my receipts and discovered I had been charged a £3.50 buy back guarantee fee. I had not been advised that this was to be added to my transaction and indeed the receipt says 'If you have chosen to save money with our buy back guarantee....' Some choice! I had no intention of selling any currency back and did not require the service.
I wrote to First(now Last) Choice asking for a refund but was told that because the fee was shown on the receipt I had accepted it. Has this happened to anyone else and indeed is it legal?
