TERMS & CONDITIONS:

This Giveaway (the “Giveaway”) is open to residents of the UK (excluding the Scottish Highlands and the Channel Islands) only for entrants who are aged 18 years or over at the date on which they enter the giveaway, but excluding employees and their immediate families of the Promoter and anyone else professionally associated with this Giveaway.

2. By entering the Giveaway, entrants will be deemed to have accepted these terms and conditions in full.

3. The Giveaway will close at 23:59 GMT on 23/10/2022 (the “Giveaway Period”). Entries received outside of the Giveaway Period will not be eligible to win the prize.

4. No purchase necessary to enter the Giveaway.

5. Internet access required.

6. To enter the Giveaway, entrants must follow the entry mechanic by entering their details into the form and submitting it.

7. Maximum one (1) entry per household will be accepted.

8. Entries (bulk or otherwise) made from trade, consumer groups, agents, third parties or syndicates will not be accepted. 9. All entrants will be required to provide a genuine email address that is personal, valid and accessible throughout the promotion. In the event that the specified information is not provided or is incorrect or an alias, the entry may be considered incomplete and therefore the Promoter reserves the right to invalidate the entry.

10. The Giveaway is not in any way sponsored, endorsed or administered by, or associated with Instagram or Facebook. Entrants acknowledge that Instagram, and Facebook shall not have any liability to them in connection with the giveaway.

11. One hundred (100) winners will be chosen on a first come first served basis from all entrants. The winners will be contacted via the email address provided upon submission.

12. Each winner will receive the following: 1x Crab Apple Tree Sapling, 1x Oppo Brothers Ice Cream Free Tub Voucher & 1x Oppo Brothers Gold Spoon.

13. All entries must be received by 11.59pm on Sunday, 23rd October 2022. The 100 winners will be selected on a first come first served basis by The Promoter on Monday 24th, October 2022 and the winner(s) will be notified on or after this date

14. All costs and expenses not included within the Prize are the responsibility of the winner(s). Any tax payable by the winner(s) as a result of the prize being awarded will be the responsibility of the winner(s).

15. Each entrant shall enter the competition via the sign up form on our website (www.oppobrothers.com/pages/tree-tub-giveaway).

16. The Prize cannot be replaced if lost or stolen. The Prize cannot be returned, refunded, exchanged or transferred. The Prize cannot be sold or auctioned.

17. There is no cash alternative available in whole or in part. The Promoter reserves the right to substitute the Prize for a similar alternative Prize of equal or greater value.

18. Entrants will need to ensure that they are available to take delivery of the Prize, or that they arrange for a third party to take delivery of the Prize.

19. In the event of circumstances outside the reasonable control of the Promoter, or where fraud, abuse, and/or an error (human or computer) affects or could affect the proper operation of this giveaway, and only where circumstances make this unavoidable, the Promoter reserves the right to cancel or amend the Giveaway or these terms and conditions, at any stage, but will always endeavour to minimise the effect to participants in order to avoid undue disappointment.

21. Incomplete entries or entries not made in accordance with the entry instructions are invalid.

22. The Promoter does not accept responsibility for network, computer, hardware or software failures of any kind, which may restrict or delay entry to the Giveaway. The Promoter reserves the right to verify all entries including but not limited to asking for address and identity details.

23. The Promoter reserves the right to refuse to award or withdraw Prize entitlement and disqualify or refuse further participation in the Giveaway where there are reasonable grounds to believe there has been a breach of these terms and conditions or any instruction forming part of this Giveaway's entry requirements or where a participant has gained an unfair advantage or won using fraudulent means.

24. If the Promoter fails to comply with these terms and conditions, the Promoter is responsible for loss or damage an entrant suffers that is a foreseeable result of the Promoter's breach of these terms and conditions or its negligence, but it is not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if it is an obvious consequence of the Promoter's breach or if it was contemplated by an entrant and the Promoter at the time that the entrant entered the Giveaway.

25. All personal data submitted in connection with the Giveaway will be processed by the recipient as a controller pursuant to its applicable privacy policy.

27. The Giveaway and these terms and conditions, and any dispute or claim arising out of or in connection with them, are governed by UK law.

28. Each entrant can bring legal proceedings in respect of the Giveaway and these terms and conditions in the UK courts.
