  • They didn't supply a POPLA code. I would try POPLA but they state not to apply to them if I have paid the charge, which I have. Will read the sticky, thanks

Sorry, having read the word 'appeal' I assumed you were at the early stage of a parking charge - so ignore the POPLA point, that ship sailed 4 years ago.

If you want your money back you need to go straight for the jugular, not pu-ssy footing around looking for chinks in the armour, issue a Letter Before Claim for the amount you require. There are various LBC templates on the internet, including one by the CAB. Maybe they'll cough up at that stage to avoid having a court claim being issued against them.

Whether you go as far as a court claim is entirely up to you. There's no cost, or risk, in issuing a tracer LBC to start.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

  • I'm up for that, trouble is at the moment wrt whether the camera was misaligned, it's just hearsay. I've put up a couple of posts on local news sites and tripadvisor to see if anyone can throw more light on it. I remember I was in a free space when the "after" photo was taken but I can't find so far any reference to false claims due to misaligned cameras anywhere.
  • Does your PCN have entry and exit photos ? That should show you if the camera is at the same angle as the one in Google Street View.
  • Yes, 2 photos taken from different angles. Each of the front numberplate. So the one in the photo aimed at the exit could easily have been misaligned enough to have caught my car while parked in the free spaces next to the wall.
