Should i fight this fine? Unsure of my case

Hi, 

I've been reading all of the advice on this forum which is excellent but I'd like some advice on whether I actually have a good defence for an outstanding claim.

I've only just recently become aware of an outstanding ticket (old address my fault) that was issued last year after i parked in a members only car park at a marina, with an automated system for entering your license plate. My family are members - and on the day i found both options for entering my number plate were closed for the day and i was unable to do so.

This is where i was a bit foolish, i neglected to take photos as evidence and said to myself i'd ring the marina office the next working day, however i then forgot to do this and hence i've recieved a fine. The marina/land owner has now been very helpful and I have in writing confirmation that we're members and its quite possible (they cant provide proof) the locations were closed on my visit. They tried to speak to Civil Enforcement Ltd themselves but have been told its now at a stage where i had to speak with legal.

I spoke to the legal department at Civil Enforcement Ltd and is currently just at claim before action, do i have any hope of fighting? I feel like the lack of hard evidence is an issue. I got disconnected before getting a chance to fully argue my case, they offered to reduce to £100 over the address issue but i need some advice on how or whether to keep pushing.

    It's not a fine - it's an invoice - and you should read the newbee's thread.
  • Correction - It's at the stage of 'Letter before action' i think is the term they used

    I did read this but i felt like it was unclear whether i should pursue based on the given examples, but i'll do more research thanks

    The burden in court would be theirs to show the system was working, not your burden to show it wasn't!
