Gladstones Solicitors - 2 LBC from UKCPM within 5 weeks.

Hi all,

Apologies if this has been posted previously, I hate to be that person but I had a look and could not find a similar situation as it seems majority of people respond to the NTK.

I received a 'PCN' from UKCPM in 2021 August in relation to the parking provided by my Gym. I tried to contest this with the gym directly but they did not offer to help me or contact UKCPM for me. As they are registered with IPC, I know from previously they are a bunch of scammers that will not take any appeal and therefore ripped up every correspondence with them from their scam companies.

Fast forward to this month, I have now received two letters from Gladstones Solicitors, 1 in regards to the Gym parking above and another in regards to dropping my partner off to a Physiotherapy treatment around the same time both from UKCPM. 

I have followed the Noob thread and sent a SAR to UKCPM and emailed Gladstones to put the charge on hold whilst I get debt advice and that I reject the claims and that they cannot treat it as two separate claims but one claim. 

I am planning to strongly refute and fight both of these charges and have found some very good help on this forum, especially in regards to the robbery charge they add of £70 admin fee making the charge £170 instead of £100.

However, is there anything I can do in regards to the two separate LBC arriving within the same month? - surely they can't proceed two claims against me from the same client, or will I have to defend both the claims?. 

In regards to the Gym itself, will my payments out of my bank and proof of my membership suffice in a claim alongside other points raised in this forum?.

    Update: 

    I just realised that their have my surname wrong with a misspelling can this form any part of a defence?.

    I forgot to include that for the first LBC, I submitted a SAR but forgot to email Gladstones to put the case on hold and UKCPM asked me for further evidence and Gladstones have now sent me another letter found below:

    Search the forum for cause of action estoppel Henderson LBC (or a combination of some of that) as your keywords and you will find a robust response written before, about two LBCs or two claims.

    No defence opportunity there.
    But check your vehicle's Registration Document(V5c) has you name spelled correctly as that is where they got your name from.

    Are two different car parks involved?  If so there are likely to be two different landowners, different sets of signage with possibly different parking conditions, that I think having the claims consolidated could be difficult - and complicated to defend with one all encompassing defence, Witness Statement and evidence bundle.

    Yes you are right, silly me forgetting that UKPCM do not actually own the land but are just operators.

    Do these Ponzi companies usually take a while to reply back to anything?. They still have not sent me my SAR nor a reply from Gladstones yet frustratingly.

    Any company has one calendar month to respond to a SAR.  When did you submit it?  What did you send to solicitors such that it requires a reply?  If it was to put the case on hold for 30 days due to pre-action protocol for debt claims they very rarely reply.

    Ah okay makes sense, it’s because I submitted an SAR nearly 2 months ago then they relied after the 30 days rejecting it saying they need more info but if I reply they will get back to me in a week and it’s been 2-3 weeks

    Get after them and complain to ICO.  Depending upon what you put in your original SAR and what "more" info they want, they could be using stalling tactics!
