Secret Commission Lawyers Fee

Options
Unfortunately, we are unable to proceed with your claim as we have received confirmation from the bank that your agreement was included in a bankruptcy. As such we have incurred an issue fee which was paid to the court. We will cover any fees for the work we have carried out on your claim however, you will need to cover the court fee of £205.00

Legit or not can someone please advise. I have not been involved in any Bankruptcy just a DRO.

In bankruptcy the right to take any action would belong to the OR. Would need to check a DRO but it might be the same.

Did they ask at the point of taking you on whether you have had any bankruptcies/DRO’s etc? If they did, what was your response?

More information required, what is the background story here?

Am I correct in thinking you issued a PPI complaint on a debt included in your DRO?

Who sent you that message? was it a 3rd party claims company? random message?

Occasionally a creditor will bundle bankruptcy/DRO under the same banner.

Thanks for the replies. It was a claim for commission on loans, Secret Commission Lawyers contacted me. No discussion of DRO.

It was a claim for commission on loans,
That is an unusual claim that usually fails.   However, the claims company should ascertain the facts before taking action.  Their failure to do so led to this.    However, it will probably mean you employing different solicitors to fight these solicitors.

For those interested and with thanks to those who replied. I emailed the company and explained my situation and they have very kindly cancelled the bill. Absolutely awesome and caring replies to my emails. Shocked but very happy.

very kindly cancelled it because they realised they had messed up in the first place by not obtaining basic facts that they are expected to get.

A good outcome for you but the journey getting there should never have happened and should not be perceived as caring or awesome.

They did send me the agreement form which had a tickbox for Bankruptcy. I was unaware a DRO was classed as bankruptcy so didn't tick it. That was there case. After the initial giddiness of avoiding the bill I do think maybe they knew they were on thin ice. Nevertheless, ultimately pleased with the response.

  • DRO isn't a bankruptcy but the principle is the same in terms of whether they should be trying to get money back as you would never see it

Do keep in mind sites like this are excellent resources for complaints etc, never use third parties, especially those who contact out of the blue offering magic free money with stories which are obviously false e.g. secret commission
