Car flecked stone up, insurance denying liability

Car stopped beside mine to allow to me to pass. As I pass, other driver pulls away sharp on some loose gravel...flicks stone up and chips my wing and cracks the windscreen.
Other driver happy to admit [as its a company car and he's not bothered]
His insurance company saying 'no negligence on our drivers part' and rejects it.
Thoughts...
Appreciate there is windscreen cover in my policy etc but chip isn't covered etc...

As they said no negligence. Just get the screen repaired and touch up the chip.0

No negligence unless you have a witness that can testify that the driver pulled away recklessly.

Do you have dashcam/CCTV or independent witness evidence of his unreasonable pulling away?
In the absence of that its bad luck and one of the risks of driving (particularly on gravel)0 -
Sadly it's just one of those things. Similar to if you drive over a nail in the road and get a puncture - it's no-one's fault, just one of the joys of motoring.Your insurance should cover the windscreen, and a stone-chip is easily touched up yourself - or, if you want a really "professional" job, one of the many "chips-away" type outfits will be able to do a first-class touch-up for very little money.1

Out of interest, were you going in opposite direction ? Did you turn round and chase after the driver and force them to stop ?0
