To SAR’s now or later

Hi all newbie, I’ve had a letter from DRP yesterday, no prior PCNs from Smart Parking. V5 address is correct so playing the waiting game for LBC.

I’ve not been successful getting blood out of a stone in my 40 years on this earth so have not contacted or will be contacting DRP (original invoice from smart parking according to the DRP letter).
So my question is should I ask for a SARs now or later based on the following.
- I’ve been doing some digging. I obvs have the reg and the PCN no from the DRP letter so I’ve been on Smart parking’s website to look up the invoice as I’m clueless to what I’ve done. On the website I get a message which says no record.
- I’ve checked multiple times the details and still get the same.
Which narrows it down to
a - they don’t have anything on us other than someone has seen us parked up.
b - they do but someone has not done there job and uploaded it yet (invoice dated 20/8/22)

I’m loathed to stick my head above the parapet. I’ve read enough to know DRP go full throttle as I am sure Smart will inform them I exist.

So should I SARs now, hope my theory is true and they haven’t got anything on me and watch them slop off to the next unsuspecting soul but risk all hell breaking out with DRP or continue to wait until LBC?

You could be waiting a long time. To all intents and purposes, Smart don't do court.
So my question is should I ask for a SARs now or later
SARs is a very nasty disease, SAR is a Subject Access Request!  If you want to send one, do it whenever you want, it won't cause Smart any problems, nor will it result in 'all hell breaking out'.  It's all an automated, computerised process designed to press you to pay them. No one is going to read your SAR and think 'We've got nothing on this one, we'd better drop things', it doesn't work like that.

Now you're at DRP stage, just file all their silly letters, but ignore any of their pleadings and threats. This ain't going nowhere.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

SARs is not a verb!  You submit a SAR (Subject Access Request) and you receive all the data that the PPC hold on you.  It is never too soon to submit it and the data you receive will help you at witness statement stage.  You submit your SAR to the PPC not the debt recovery company (DRP).
