UK PARKING CONTROL LTD are taking me to court over an unpaid private parking ticket

Did you change bank/credit card details to the new address and register on the electoral roll whilst there? In other words, were you 'there to be found' by a soft trace? I think this would make a differenceThe pen is mightier than the sword ..... and I have many pens.1

No it is not 'completely legal'.CH1991 said:I did not update my V5C as I do not use my car in London and if I did change it, my insurance would have doubled. As I do not use the car anymore I decided to leave it as was. Which i believe is completely legal.
The keeper's name and address on the Vehicle Registration Document is the address where the keeper can be contacted. It is nothing to do with where the vehicle is kept, therefore it will have no effect on any insurance premium.
I wonder how many other more serious issues have passed you by?
Any speeding offences, dangerous driving, etc. will all have been sent to the V5c address. You may even have clocked up points leading to a ban from driving without knowing it.
It's a risky game you are playing.1 -
I do not drive the car whatsoever. So it would be impossible to have had any speeding offences or dangerous driving claims, as my car is constantly kept parked and unused. As long as I am not using the car whatsoever, I am legally allowed to keep the car at an old address with the logbook unchanged. I cannot park the car where I live in London - So it was the only option for me.
My drivers license is updated with my new address, so DVLA are aware. My banking details have not been updated. I moved to a new address for work and the timescale was meant to be for a few months, but has ended up being much longer than that, hence why I did not go through the efforts of changing all of the admin, before having to change it all back again a few months later.
Taking all of this into account - I had no idea of the court proceedings. Is there any way I could go around getting a set aside for this case? Or explaining why I did not receive the claim form to the judge? I could really do with not wasting £334 right now. So any help on this matter would be hugely appreciated

Keep the car where you like.CH1991 said:As long as I am not using the car whatsoever, I am legally allowed to keep the car at an old address with the logbook unchanged.
As I said earlier, the address of the Registered Keeper on the V5c is a contact address.
This FOI request may help...

Note the words......the law requires the keeper of the vehicle to provide an address at which they can be reached.1 -
You must have driven it at some point else how did you receive parking charge notices? The two parts of the DVLA do not talk to each other and licence has no connection with registered keeper info. If you use another address, you should make sure you pick up your post! The NEWBIE sticky second post explains the procedure for set-aside, it will cost you £275 unless you qualify for help-with-fees (ask Auntie Google) such as being on benefits. You will have to complete a N244 form but all this is explained with links to examples. Search the forum for recent examples of set-asides or read some replies by @henrik777.CH1991 said:I do not drive the car whatsoever. Okay. Excuse my naivety. The DVLA have my new address. Like I mentioned in my previous post, I was scheduled to move for a few months. I have now been in my new address for 1 year. Hence why originally I did not change the V5C.
Does this mean I have no leg to stand on? Is there anything I can do to appeal for a set aside?0 -
I have not driven the car for 12 months. This PCN from UK PARKING CONTROL Ltd was from over 2 years ago!0

PPCs (as everybody) has up to six years to start a claim. The DVLA might have your address now but the PPC can only ask for your address once. I suggest you spend a bit of time in the NEWBIE sticky: -**NEWBIES!! PRIVATE PARKING TICKET? OLD OR NEW? **READ THESE FAQS FIRST!** Thankyou!
Then scroll down until you see: -
HAVE YOU FOUND OUT ABOUT A CCJ (JUDGMENT FOR CLAIMANT) AND NEED IT SET ASIDE?
and continue reading and follow the link and search for other threads, quite a few recently where posters have successfully had CCJs set aside. Read this thread: -

Is there any way I could go around getting a set aside for this case?Yes. Almost certainly.
See the CCJ set aside section in the NEWBIES thread, which you don't have to entirely look through. On a laptop you can hop straight to it (as with any webpage) by putting CCJ in when you do control & f.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
