  • You’re correct that if cancelling under the CCR’s then you’re entitled to the original (basic) postage fee refunded. However, did you advise them in writing that you were cancelling under the CCR’s? If not, then you’re bound by their return policy which is in addition to your statutory rights.
Good point.  I've often wondered when people are told that they're entitled to "whatever" under the CCRs, whether they've complied with the necessary requirements to cancel an order (or withdraw an offer to buy) under s32(3)(b)...

Many a time, if you cancel under CCR’s, you would then be liable for the returns costs and I doubt returning the items to store would fall under this.
Does it have to be in writing, telling the person in the store you are cancelling under the CCR is good enough ?

That also is a good point!

So did the OP tell the store assistant "I am cancelling this order under s29 of the CCR"?
  • That also is a good point!

So did the OP tell the store assistant "I am cancelling this order under s29 of the CCR"?
I never used the word "cancel", my words were " I no longer want this order" and quoted that I am entitled to the postage refund under Consumer Contracts Regulations.
I feel that is a clear statement of waning to cancel under the regs (I don't believe it states I have to use the word "cancel"

Even if I had used the word "cancel" or any other words the outcome would have been the same, the person had never heard of the regs ("I don't know what you are taking about, Head Office told us no refunds on postage"

Paypal refund for postage has just been issued.

In this case - as opposed to the sofa case - I think I agree with you.

If you paid for Wilkos's's's's standard lowest cost delivery then I think you should get it back from them
