Gladstones PCN LBC email response

Hi, I'm new here. I was browsing the newbies advice forum before and have sent SAR request and request to Gladstones to put the case on hold. Now 4 months later they emailed me that the case is no longer on hold and push me to pay. Although the email is more of an informative and doesn't seem like they are awayting response should I email them back to say I don't agree and I'm ready to defend in court?

Yes and if it were me, I would reiterate your defence position and attach any compelling evidence you wish to rely upon, such as your tenancy agreement if it's a residential car park situation.

Which PPC and what went wrong?

If you have responded to a LBC/LOC, then there is no point in responding again until you get a claim form from the CCBC in Northampton. Just make sure Gladstones have your correct and current address and that it is the same as on the V5C.

Plan A is always a complaint to the landowner and your MP, and it's never too late to do so.

What is the name of the PPC please, and where did the alleged event occur? It may have cropped up here before. What was the reason for the PCN being issued?

I suggest you start preparing for a claim by reading the guide to court written by bargepole you will find in the second post of the NEWBIES sticky Announcement, and in the template defence sticky Announcement, as well as getting evidence including photos of the site and signage.
Google Streetview may have historic images if the alleged event wasn't recent.

  • Thank you for the replies. The PPC is Premier Parking Enforcement Ltd. for a parking in a Birmingham city centre. I basically paid earlier for the whole evening nearby and moved the car to this location without realising it's a privately operated car park (quite a few in Birmingham centre it turns out). There was a penalty sticked on the windshield when I returned and forgot about it until Gladstones sent me the LBC.

Was it a penalty charge notice or a parking charge notice?  Makes a difference as penalty means it was council.
