reply form alliance parking

I have recently recieved a letter of claim from alliance parking, They issued a ticket whilst parking in Parc Tawe Swansea, I was driving a disability vehicle with my partner in the back who is wheelchair bound. The vehicle is fitted with a side entry cassette lify which requires 1.6 meters to be available to the side. There were no disabled spaces available, with three cars not displaying a blue badge we parked in a normal space but slightly over the adjoing empty space to ensure that the lift could be used and while we were away, which was abour twenty minutes, there were pleny of empty spaces in the section we were in. that was back in Dec 2022, I appealed and lost as expected, refused to pay and heard nothing until September, They have now sent me a letter of claim and asking for me to complete and return a reply form which they say is an official court paper which asks too many financial questions for my liking, and I will not send these to alliance parking. My question is this, can I ignore the reply form and await the court papers from the court itself without damaging my defence. I have responded to the letter of claim denying the offence based on a number of disability reasons and asked a number of questions some of which they declined to answer.

    If this is an actual Letter of Claim/Letter before Claim, you do not need to fill in the intrusive forms. Have a good read of the 'Newbies' thread. It will tell you what to do now, what to expect and generally what the whole process looks like.

    You will find the advice for a Letter of Claim is 1) SAR to the PPC. 2) 30 day debt advice hold to the solicitor. This buys you time to understand the system and get all your ducks nicely in a row.

    I am NOT legally trained, but from what you say, I would be very surprised if you lost in small claims court.
    The pen is mightier than the sword ..... and I have many pens.

    Perfect.

    Come back when you get the claim because we encourage you not to rush and just write your own defence, and there will be points to make about the Equality Act 2010.

    Parc Tawe is a 'no-go area' for motorists due to the toxic mix of parking firms that infest it.  Stay away.

    We assume you've read all the recent newspaper articles about the way PPCs are raping and pillaging this site?

    Boycott Parc Tawe and tell the retailers why.

    Who owns Parc Tawe ( the place crops up on here alot )
    Get in touch with the parking company and tell them that under the Equalities act ( aka disability discrimination) they have a duty to make reasonable adjustments for people with a disability, as there were no wide bays available the driver had to park in a way that they/ passengers could access their vehicle, by pursuing this matter, they have shown that they will  not make any reasonable adjustments.
     
    The correct course of action would be to allow the vehicle to park in such a way as a reasonable adjustment. And not to pursue the parking charge notice.
     Likewise the owners of the car park ( not the PPC) should also be informed that through the actions of their agents they are not making any reasonable adjustments for those with a disability
    From the Plain Language Commission:

  • Allince  parking have refused to tell me who the land owner/Landlord is, I have explained to them about the disabled access problem from the very first instance, I also asked other questions about disabled parking including the amount of tickets issued to drivers with no blue badge parked in disabled bays, the width of parking bays, their own disability company policy and in particular why the signs are so high that a wheelchair user has great difficulty reading the contract in small print. Their response what the information I requested was not relevant and added I should have driven around the car park until I found a sign that was low enough to read

    And then they would have stuffed you with a PCN for taking longer than 10 minutes to purchase a ticket!  What a ridiculous statement from them!
