NHS Fleet Parking Charge Invoice

I have received an invoice from NHS Fleet for an unpaid parking charge invoice from April 2022. This is the first I have heard of it. I have had no notice to Hirer and the PCN they have sent is addressed to  Volkswagen Group Leasing. I believe the invoice is invalid  as neither party has followed the Protection of Freedoms Act 2012 by which they can discharge any claim on themselves by providing the Hirers details. They have done this many times over the last 6 years with PCN's I have appealed and won.

I am worried if I don't pay the fine they will threated to pass the debt onto a collection Agency as they have done once in the past but this was earlier in the lease when I didn't understand my rights.

Any advice ?

    It is not a fine.
    Debt collectors are powerless and can safely be ignored.

    It is nothing to do with the hirer/lessee unless and until they get a NTH in their own name. The danger however is that the hire/lease company might erroneously decide to pay the charge and attempt to then charge you for the privilege.

    You seem to be up to speed on this, so I suggest you contact the hire/lease company and tell them in no uncertain terms that they must not pay the charge but must instead pass your details as hirer/lessee to the PPC as required by the strict requirements of the PoFA 2012.
    If the hire/lease company are a member of the BVRLA, then you should also remind them that their trader association has told its members not to pay PCNs but to instead transfer liability as prescribed by the PoFA.
    Warn them that you will take legal action against them if them do pay the charge and then charge you.

    Plan A however is always to complain to the landowner and your MP, but you still need to ensure the hire/lease company are taken out of the loop before they do something stupid.

    Did NHS Fleet attach the PCN?

    Have they said that they passed on your name and address to the parking firm?

    Which PPC?

  • No. It was Parkingeye the PCN isn't even in the name of NHS fleet. Seems to me VW leasing has missed the POFA procedure and just sent the PCN to NHS Fleet.

    What VW Leasing did is fine, but NHS Fleet are in the wrong if they didn't name you as the vehicle's keeper.  You need to ask NHS Fleet if they have (and for a copy of the PCN).
