In practice, threatening to go to court ought to be enough, as the other party will realise how expensive it's going to be, both in legal fees and the fact that the circumstances will probably put off many buyers and therefore reduce the price. I doubt a court is likely to say no, beyond perhaps giving some reasonable time for the other party to find somewhere else to live.
