Your defence is not the same thing as a witness statement and evidence bundle. Please read the section in the 2nd post of the NEWBIES thread in red capitals: IMPORTANT: KNOW WHAT HAPPENS WHEN.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

The usual timeline is Parking event followed by PCN, NTK, increasingly angry debt collector letters, Letter Before Claim, N1 claim form, complete AoS, submit defence, receive (from CCBC) and complete N180, Notice of Allocation with court date, submit Witness Statement.
It is not possible to alter your defence unless you pay (£275 - I believe) and you will have to go with what you put but you could do as suggested by @Coupon-mad (add it to your witness statement) although you now say you have submitted your witness statement!1 -
Luckily, I don't think they are that far along yet.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Thanks for your help. Sorry I have been really thrown off course with covid, family issues and work. I had heard nothing in any event but I have read all your advice and points.
The notification of allocation to the small claims track (hearing) has now been issued. It gives me by the first week in Jan 23 to submit my witness statement. It also mentions mediation again but the form the parking people completed originally was a different version and didn't mention mediation. I cannot see how talking to the parking company will alter anything - as I say i'm not paying and they wouldn't accept anything except a payment of some sort....
I mentioned I had a paid permit etc - is there a precedent on here as normally it is just for parking tickets where permits aren't relevant.

You rented a room and paid for parking - do you still have the paperwork? Contracts / agreements. What exactly did you file as your defence? what did you write? In the car park were there any signs? what did they say, do you have any photos of them?

I asked the private housing company if they had copies but they say they have limited info now.
The first defence I sent in said that I had paid for a permit and hadn't received it at the time - I was emailed an exemption letter which I was placing in my car each day - For whatever reason there was a day when I got a PCN on my car saying no permit displayed. For the other 200 days I was there I never had a PCN as my permits were "resent" and then I moved to another property just up the road where an email confirmed my permit would still be valid. I said that I contacted the housing company who said the case was on hold pending appeal with the parking company .... I never heard anything for ages so assumed the housing company had told the parking company I had a permit .... not unreasonable as I had already paid.
I cannot remember as didn't really take a lot of notice ... nothing easily visible - I can go back and take some but they may have changed them I guess they could argue.
I am thinking that I cannot add to that now ? But maybe mention other things when I have to go to court ?0 -
If you paid by card or bank transfer then your bank will have the evidence you need if that payment. And you may still have emails? You need evidence.
As for the WS, just adapt your facts and exhibits into the example posted by @aphex007 after he got advice on his thread.
Use his bundle as your base and change the facts.

Keep on going. A decent witness statement will probably result in the scammers offering you the opportunity to settle at a ‘time limited discount ‘ and when you ignore then discontinuing just before the court hearing1
