He has insurance.  If he hasnt produced the docs already, he should be able to show the original policy for the original reg and the policy now updated with the new reg.

There was continuance there and at no point was the car not insured.

I dont think that warrants 6 points for no insurance.
The police officer thought he didn't have insurance and I agree with him. He was insured on that registration number, not the VIN number.
The information available to the police at the time was both registration numbers relating to the car. Both with the same VIN.

I can understand your ignorance of how the PNC works but it's not acceptable from the Police.

@Ectophile if I raise it with Ombudsman which might take months to get a response on, and during this time will the court still give me the penalty points or wait until we hear from the Ombudsman? Sorry I am very new to this whole process of ombudsman and all. Thanks

The courts have a big backlog at the moment.  The Ombudsman may take months to hear your case.  How lucky are you feeling?
The court may not decide to delay the case while the Ombudsman makes a decision.
    If it sticks, force it.
If it breaks, well it wasn't working right anyway.

You cannot Legally have two cars with different registrations and the same VIN. The OP was lucky he had an understanding Police Officer. Usually the vehicle would have been seized and you would have spent some time enjoying the accomodation of the local nick.

    Who said you could?

Why would you be in the local nick for no insurance?
Even when there were arrestable offences (before 2005 I think) no insurance wasn't one of those offences. By today's standards given the OP was reported what would the necessity be for arrest?

I did say that the Police Officer was understanding but he could just as easily have viewed it as a criminal act with cloned plates.
I do recall explaining to a customer that their car had been seized (or should I say Three Cars) - all because they brought it in for a recall and we could not match the VIN plate to the one stamped on the chassis.
We called the Police - not the first time we had come across a dodgy motor.

The way that some posters are viewing this, put a private plate on a car and avoid speeding fines, but they think the offender should be let off. The OP  could have had numerous speeding fines, but the owner could not be traced.

Where's the criminal act if the plates matches the vin and the car is registered to the OP?

How do you avoid fines with a private plate that is registered to you at your home address?

Have you made the assumption the OP hasn't sorted things with the DVLA? He obviously had or the charge would be no number plate.

I've said it before but will repeat myself.  on a check of the VIN, and even on checking the cherished plate, DVLA will show the original plate matching the VIN.
  • I have updated dvla about the reg plate it is just the insurance provider I didn’t update.
