Historical "Private Street Works"

Hi all,

I'm posting on behalf of a family member currently selling their home which they have owned since c.2000. They're now in the final stages of sale and exchanging contracts however council searches have discovered an unpaid debt of £180.84 for "Private Street Works" from 30 Dec 1982. The council are now asking for this to be paid with interest as part of the sale for over £4,000, despite this being of no relation to the current owner.

Is this justifiable considering there had been no prior notification of the outstanding charge by any means?

    this debt, if you ask me, belong to the owner of the house, whoever that is. what I would say is that when the property was bought, the solicitor should've raised this. it sounds like it fell through the cracks.

    Is this a local land charge registered on the property?

    If so, then when buying the property the local search should have picked this up.
