Gemini parking solutions

Hello all,

we use a leisure centre where the parking is controlled buy Gemini. The procedure is to register your stay via a console in the leisure centre. This involves entering the car reg and then confirming the details twice. On this occasion I failed to confirm on the second prompt and thereby not registering as instructed. We got a £60 charge notice. We appealed but this was rejected. We followed up by appealing to POPLA providing evidence that we were indeed using the facilities of the leisure centre. This appeal was rejected by GEMINI with them stating that 'Unfortunately, merely using the leisure facilities does not allow parking. Validated parking is a requirement to park. As shown previously, the vehicle was not validated at the time of the contravention'. This seems grossly unfair as they now want £100! Do i have any chance of appealing this charge? I will be approaching 'BETTER' who run the leisure centre to see if they can help. Thanks.

    Just ignore it if you lose at POPLA and the leisure centre don't cancel it.

    NO PAYING THIS 'OUTRAGEOUS SCAM' PCN.

    Gemini are not litigious but only come back here to post if you get s small claim.

    Obviously, you can totally ignore debt demands but that's already explained in the 4th post of the NEWBIES thread.

  • Coupon-mad, Sorry, I'm in England, should have said. I'll see what BETTER have to say. I do have a chance to appeal to GEMININS ruling via POPLA which i guess i should do and await their responses. I'll check out the NEWBIES section. Did this in a hurry as only got this demand today and i'm fuming! Thanks

    You've already appealed to POPLA but you won't win because you can't prove what you did.

    Have a look at POPLA Comments stage which is where you are at. 3rd post of the NEWBIES thread. You cannot appeal again. You are merely adding minor bullet point comments.

    You haven't got a 'demand' today if it's merely Gemini's response to POPLA. That's not a demand.

    The landowner can cancel. Whether they will or not is another matter.

    Gemini don't sue people very often and if they do, come back as court is better and fairer than POPLA (and there is no CCJ risk as long as you don't ignore court papers and don't move house within 6 years without updating Gemini).
