Section 75 grey area

Hello, I have a question on Section 75. I was due to have building work started so paid the company a deposit of £9200. £9000 was bank transfer and £200 was credit card. The company have either gone bust or we were scammed as they are no longer responding and not started the work. 
So trying to get money back. I know section 75 says you can claim the money back even if only part credit card (I have the receipt from the company showing split of payment), but the quote of the build was over £30,000 which is the max for Section 75. I’m not claiming the full cost of the build (as never paid that) I am only claiming the deposit I paid. Would that be covered under section 75? Some others in the same situation have said the banks have said it won’t be covered at the total cost of the build is over £30000 but others have got the money back. Just want to know the rules before I raise a claim and maybe have something to push back on if declined (or will try not to show them the full quote if is not covered) Thanks
