CCJ Compensation / Wrongly Submitted


Im looking for an positive avenue in how to register an unfair ccj, which had nothing to do with us, it was set aside immediately. We had the CCJ set aside for a parking charge notice.
The thing was, the CCJ was initially sent to my old address over a year ago, so we knew nothing about it until we were refused a double mortgage transfer application on 2 properties, this is when our advisor contacted us, and highlighted the issue.
It occured a while ago, on a vehicle we sold to a family member, a parking charge came through to the old address which we moved from over two years ago, the parking enforcement company obtained the information from DVLA, The info they had was that the car was registered in my wife's name..But we sent off all the relevant info/change of keeper and date etc to DVLA, when we sold it.
We contacted the keeper (family member), and they sent us a copy of the V5 with the new details and date etc...but some reason the system at DVLA gave out previous details.
This resulted in a CCJ being registered in our name, and caused us a considerable amount of financial loss, through missing deadlines in gaining acceptable fixed interest rates that were available at the time.
For months we kept showing the evidence and finally we had this accepted through the courts on having it all set aside, but it has cost us dearly,,,where do we stand in our loss, let alone the stress and inconvenience it has caused.
Can we get compensation from whoever is responsible....if so, where do we start.

The organisation is likely to ignore the complaint if they are aware it has gone legal
I imagine the ICO will want to know what the OP did to try and resolve the complaint with DVLA

Complaining the the ICO is not 'going legal'. Exhausting the internal complaints procedure is a requirement when making complaints in respect of financial products but you can complain the the ICO anytime you choose. I would image very few people have had what they would see as a positive outcome in respect of complaints to the DVLA.0

If you have a complaint or are unhappy with the way you have been treated by the Driver and Vehicle Licensing Agency, you should make your case in writing.
Compensation may be paid in some circumstances if you have incurred financial loss or expenses as a result of the problem.
You should give your full name and address, your date of birth or driver number, the vehicle registration, make and model and your phone number.
Send complaints to the -
Customer Services Manager, DVLA, Swansea
SA7 0EE.Alternatively, the ‘make a complaint’ online form can be completed at direct.gov.uk/emaildvla.
The DVLA aims to answer complaints within two weeks.
Motorists who are still not happy after the initial response should write to the DVLA’s chief executive Simon Tse at -
DVLA Swansea, SA6 7JL.
Again, allow two weeks for a response.
The chief executive can refer the matter to an independent complaints assessor if you request this. The assessor can look at matters involving poor service, incorrect advice or unreasonable delay.
You can also complain to your MP and they can refer the matter to the Parliamentary and Health Service Ombudsman, whose decisions are not legally binding but are invariably followed.
Compensation can be recommended.
