I partly blame the Hotel for:

    - not having clear signs informing drivers at the entrance barrier ' THIS IS NOT AN AIRPORT CAR PARK. THIS SITE IS FOR HOTEL GUESTS ONLY DURING THEIR STAY'

    and worse:

    - trying to extort a huge £100 or £200 to lift the barrier when it seems there are NO contractual signs whereby a driver has agreed to this and nor is it proportionate or recoverable in law.

What the Hotel did is like a clamper (pre-2012) operating with no signage whatsoever, demanding a fanciful £200 for release of the car.

Whilst a landowner CAN charge to lift a barrier, it must be a proportionate sum and there must be signage.

Alternatively they can of course claim for damages.

But none of that applies here.

only thing they have is a sign saying about hourly charges which is not lit up at night and no signage once you enter the car park anywhere, so that would be my arguments too as well as your points.

thanks so much and keep you posted!

OP, I'm afraid that you cannot control who posts on a thread on a forum.

I will come back if i receive anything.
The manager of the hotel was appalling didn't care in the slightest! But i guess he is only doing his job.

If anyone has had something similar happen do add a comment :-)
Only doing his job ?   If you owed £200 and he was prepared to drop it to £100, then If I was his employer I would sack him !
If you think this through, it was just a little sideline for him and nothing "official" at all !
