Hi, it's that time again!!.... I will keep it short as I know what it's like trying to decipher some of these!
I got the attached through the post at the weekend. Circumstances are;
1. They say in their letter that the carpark clearly states a 2 hour limit at the entrace and that I was "in the carpark" for 3hr 12 minutes. I didn't notice that sign but I have a picture of my car taken at the time, parked right in front of a sign which clearly shows that the parking limit is 3 hours. It seems there are several signs dotted around the carpark and that they don't match (hence why I took the picture at the time).
2. The signage was contradictory and the long and short of it was we were driving around the carpark for a good while trying to work out what on earth you're meant to do and how long we were actually allowed to stay for. We eventually plumped for 3 hours because it seemed reasonable based on the above.
3. I can't say for sure, but with all the driving around trying to work it out, I don't think we were actually "parked" for more than 3 hours either.
4. We bought £60 of shopping in Asda during this time so can show that we adhered to their terms on that front.
Any thoughts on next steps and appeal? - I did a search for Asda for the landowner complaint but couldn't find anything. Does anyone know if there is a specific contact for this that people have been using?

Your VRM is showing on back of the NTK.
Complain to the store manager and ASDA CEO and your MP.
If that doesn't work, then appeal using the template in blue text. Add to it that the permitted free parking time is greater than the two hours they quote on the NTK, therefore the specific reason for issuing the charge is incorrect.
I would leave that until after day 15 to ensure they can't reissue a PoFA compliant NTK.

I did a search for Asda for the landowner complaint but couldn't find anything. Does anyone know if there is a specific contact for this that people have been usingIt's the local manager who will sort this out for you - not seen any HO involvement before - never seen a manager turn down a request for a cancellation.Take receipt for the day (or cc/bank statement) showing the transaction, along with any other proof of previous Asda patronage. Asda seem not too keen on upsetting their customer base!Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

Can you give me the heads up as to where that 3 hr sign is the car park, if the rest of the signs say 2 hrs? I might get a photo...PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
