Parking charge notice for being 16 minutes over due to a breakdown

  • Can I thank all who have taken the time to read and answer my plea for advice on whether to pay the parking charge notice and the demand from debt recovery plus.as a 68 year old oap widower the threat of court action has really got me worried as it has now reached £170 for a short overstay due to an electrical lead needing re-positioned had me 16 mins over the 3hr stay,company did not want to know and insisted on payment after contact with dvla

    Perfectly safe to ignore these letters.

    Come back if they ever try a small claim but in the meantime please complain to the landowner.  They can cancel this for you with one email.

    Was this a pay and display car park, or a max stay x hours or you will charged £xxx set up?

    A few things in your favour:
    1: Frustration of contract, the vehicle broke down and couldn't leave
       Once you returned to the vehicle and it broke down it was no longer "parked" but broken down/immobilised


    You will not be paying a penny, again, please answer the below:
    Whos car park was this? ( supermarket name location /retail park name/location)
    Was this a pay and display car park, or a max stay x hours or you will charged £xxx set up?

    Motherwell is in Scotland, so the standard advice seen in all other Scottish threads applies.

    Ignore it.

    The place cannot be Council owned, you must be mistaken on that assumption.  Councils can't use private firms to issue false £170 extortionate demands.

    Laugh at the letters and just collect them if 'PLAN A' fails to work (see the NEWBIES FAQS thread).
