CCJ wrongly imposed on me rather than company I was director of
I only discovered a couple of years ago that a ccj was lodged against me
A company I was director of folded in 2017 November a limited company a catering business
The amount was for 1150.00 approx
I realise that I am entitled to make an application to the court to have this removed but there is a charge of 275.00 for this & it is not guaranteed that the court will remove it
I had an informal talk with a lawyer & they suggested / warned that their fees may be more than the amount claimed
I understand that ccj lasts six years on your record in which case it only has another year or so to run.
Other than that an option is to pay off the ccj which I think unfair, or indeed "keep my head down & do my time" as it were, till next Autumn
(I did email the company involved but got no response. At the time of the company folding I had two threatening & aggressive members of the said company doorstep my at my own home with intimidating threats, although I did not feel the need to tell the police. They threatened to take me to court if I could not pay there & then & that was the last I heard of it until discovering the judgment a couple of years ago)
Any thoughts?

If you discovered this 2017 CCJ a couple of years ago but haven't actually done anything about it (other than a chat with a lawyer), does this suggest that it hasn't had any adverse tangible effect on your credit status over those five years, i.e. you already have what credit you need and are happy that you won't need any more for a while?
If the creditor knew where you lived, why wasn't the court paperwork served there, and why didn't anyone pursue you for the repayment once the CCJ was issued, i.e. why would someone go to the trouble of securing it but then ignoring it?0 -
This seems rather strange to me.phil_d1111 said:CCJ wrongly imposed on me rather than company I was director of

You found out about this two years ago and yet have still done nothing? Or are you now wanting to apply for a mortgage or something?
And this person went to all that effort to take you to court and get a CCJ against you, but seemingly used the incorrect address to serve papers (was there a business address??), and also didn't bother sending any sort of debt collection once they got the CCJ, despite knowing where you lived?
And also given the CCJ was in Nov 2017, it hasn't actually seemed to affect you in nearly 5 years...
I'd just wait the additional 14 months unless you desperately need it removing?
Should've = Should HAVE (not 'of')
Would've = Would HAVE (not 'of')
No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)0 -
I don't recall any papers being served. The business address was vacated at the time of the company failing.
Yes, I could wait the 14 months but yes I want to apply for finance.
Have asked the court service for copies of the original documents & pleadings0
