Default notice years later

Options
Can anyone advise?
I entered a debt management programme back in 2013 and one of the creditors were Premier Man (part of the N Brown Group).
I have correspondence from them acknowledging being in the debt management arrangement and that they agreed to reduced payments. These were paid regularly as per the agreement

In 2020 they sold the debt to Cabot and to cut a long story short Cabot told me that Premier Man had not technically given me a default notice - despite me technically not paying the ‘standard’ payments for years.

I now have a default dated 2020 against Cabot when in fact I defaulted with Premier Man years ago.

Can this be done? Cabot will have none of it when I have advised them that the default was not with them (again all my agree payments with Cabot have been met).

I just feel a bit peeved as effectively what is on my credit report is incorrect.

I also contacted one of the credit agencies (Trans Union) and they said there is nothing there can do.

it just seems wrong to me - any thoughts?

Yes, it is correct, you entered an arrangement to pay basically, when you started your DMP.

    Is it fair though?
    Well, no, not really.

A creditor can choose to mark your file as such, instead of defaulting you, which is what has happened in this case.

Time has passed now, but you may still be able to make a complaint to the original creditor, the gist of this would be that you were unfairly treated by their actions, in comparison to someone who has ignored their debts completely, they would have been defaulted, and had a clear file by now, whilst you, who took the responsible path to repay your debts, has been left in detriment by doing so.

Send a copy to Cabot as well to keep them in the loop.

  • Do you think it would result in anything if I made a complaint? I assume the default would still be showing as the most recent one in 2020.

I forgot to mention that within your complaint you should ask for the default to be back dated to when your DMP first started.

This is why you should also send a copy to Cabot, as they defaulted you, so it`s something they may have to decide between them.

It`s a long shot now after so much time has passed, but for the cost of a stamp, it`s worth a punt.

  • Many thanks - just sent an email now and I have also managed to find an email from Premier Man dated 2013 confirming the DMP so I have included that also.
