Check your old emails for the evidence of the full day parking ticket which you said you had subsequently misplaced.

Hi guys thank you so much for all your help once again this forum has been an absolute godsend.

I had the hearing today after the one on Tuesday was cancelled so thankfully it went ahead. the judge was patient and listened to most of my argument. The Claimant sent a representative again who was present.

The judge didn't accept my arguement that the claim wasn't properly served saying they parking co were allowed to send correspondace to my usual or last known address (said there is no malicious intent in these things like 'guessing' it was my university address, just a protocol [yeah right!]) , so from that the main bulk of my arguement was dismissed.

Judge used her discretion for setting aside and said it could go to another hearing where I could defend, she also said I would need to pay two further claim costs in order to be able to claim for my own costs which I'd never heard before.

Taking another day off to attend a hearing would cost me more than the £315 settlement fee being offered so I just agreed to pay and get the ccj wiped (apolgies guys, I really tried, I just couldn't let it go to another hearing). I said I made this offer to settle in september before months of work and paying the £275 N244 fee, could I get this taken off the £315, judge wasnt having any of it.

Claimant then tried to argue that the judge didn't even have the power to set aside because my draft order was for 13.2 and I hadn't submitted for 13.3, judge told him where to go and she can use her discretion.

Honestly whole thing lasted about 30 minutes and was way more tense than I thought it would be. I'm just relieved the ccj is wiped and I can put it all behind me though even though the whole thing has cost close to £600 its just not worth the stress anymore and I'm glad to be rid of it!

Also I got a serious telling off for saying 'thank you judge that's a good question' (a HOW DARE YOU SAY THAT type response.

Massive thanks to you guys again @Coupon-mad @Le_Kirk and a number of others, I really don't think I could have gone through it without your help its actually been a very stressful mental battle.
