A couple of questions ahead of the hearing tomorrow...
Is the judge likely to ask if we received the original parking tickets and why we ignored them? What's the best way to answer this?Could you summarise the 4 months dead argument in layman's terms, still can't quite get my head around it and it's a key part of my skeleton argument.
Thank you!

Following on from my question about the 4 months dead argument, as I understand it...
The court has issued the CCJ in December 2021 (at the request of DCBL), however it was never able to be 'served' as we hadn't lived at that address for 11 months (since Jan 2021). Which is obviously over 4 months, therefore 4 months dead?
Or...
Is it that the CCJ was incorrectly served in December 2021 - incorrectly due to the fact we hadn't lived at that address for 11 months (since Jan 2021). Which is obviously over 4 months, therefore 4 months dead?
Or neither!
(we have never seen the CCJ paperwork)0 -
In your latest post I am going to assume that every time you have mentioned 'CCJ' you actually mean a 'County Court Claim' rather than a 'County Court Judgment'.
A claim needs to be served on a Defendant within four months of being issued.
If it is not served on a Defendant within four months of being issued then the claim is 'dead'.
Do you know when the claim was issued? If not, ring the CCBC and ask them.

@KeithP
Yes, I guess I mean 'Claim' - this is the info we have.
We found out about the claim in August 2022 as it was served to an address we left in Jan 2021.

I've answered your 'four months dead' question.
Are you now happy with that?2 -

I wrote earlier...A claim needs to be served on a Defendant within four months of being issued.
Are you happy with that?
I continued with...
If it is not served on a Defendant within four months of being issued then the claim is 'dead'.That's all there is to it. It's not difficult.
I obviously cannot put dates to that because you haven't said (on this page at least) when the Claim was issued.
