Letter of Claim after 3 years

Hi,

I have received this letter of claim for a parking incident happened about 3 years ago (Please refer to the attachment). Date of the letter is not the incident date.

I have followed wrong advice and ignored previous letters. Then have not heard from them about 6 months.

1.       Cloud you please let me know whether I should follow process ( appeal process )  in NEWBIE thread ?

2.       or is there a different procedure as this happened about 3 years ago?

Read the LBC section of the newbies thread.

    All appeals have now passed

Send a SAR request to the claimant and an email to DCBL asking for a 30 day hold as you are seeking debt advice etc.

Plan A is always to complain to the landowner and your MP.

Where did the alleged event occur? It may have cropped up here before.

As above, send an SAR asp per the advice in the NEWBIES. You will need to include non-photo proof of ID with your request such as a V5C or redacted utility bills or bank/card statements.

At the end of this month, tell the solicitors that whilst you deny the debt you are seeking debt advice and require the case to be put on hold for 30 days as per court pre-action protocol.

Read the guide to court written by bargepole that you will find in the second post of the NEWBIES. It is a step by step guide from LBC to the court hearing.
Read it in conjunction with the template defence sticky Announcement.

We have cases with LBCs after 5-6 years. Nothing unusual here, and easy to beat.

You've got much more to do, and you must keep going, but be aware of the thread below where hopefully your case will be included some time in the future.

Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

    2. Yes. If you still use the gym then tell them you will go elsewhere if it isn't cancelled. Tell your MP as well that the PPC has added on fake amounts that they haven't incurred, and the new government parking code of practice will ban these when it is introduced. Add that the BPA has already told its members to comply with the forthcoming CoP (even though it is not yet active), but they are still doing it. Ask them to forward this to the head of the DHLUC.
The SAR goes to the DPO of UKPC.

    3. It's irrelevant.

I think there is a Legal Beagles template linked from the NEWBIES, but in any case, all you are asking for is all personal data they hold about you. Don't tell them to contact you if they want any more info as that will just give them an excuse to delay things.

  • Hi,

    1. when i send the email for SAR request to PPC's DPO, should i include Solicitors Reference no. ?
    2. or just my name & address with a scanned utility bill is enough?

    cheers

Option 2 together with any UKPC's reference number(s).
