    In complete shock reading this - the reprehensible behaviour demonstrated by your neighbour is….just unspeakable. He must have some financial interest in what happens with your old neighbours property and is clearly willing to stoop to the depths to protect whatever scheme has skewed his tiny mind.  You likely won’t be able to talk specifics on here any longer as can only imagine this is now a police matter but I wanted to say that my thoughts are with you, and hope that you are ok.

    Glad your head is okay and checked out. Spicy food is good for inflammation (if you like it) to help your arm.
    I would write down everything that has happened and include dates whilst it is fresh in your mind. Also take photos of the fence and have historical ones to hand.
    If you haven't, get both properties title deeds. It's best to get the information together now and ready. If things become awkward, by having your argument prepared with supporting evidence will make you seem less like the unreasonable party in this and more like the wronged party.
    Take it easy though.

  • I'm really shocked and saddened at this criminal issue.  But getting back to the civil matter at hand.

    Firstly get the title from HMLR. 

    I would be writing to the owner according to the title at their address setting out my issue with criminal damage of my property (you state the fence is within your property so I do not think this is contentious) caused by contractors appointed by the addressee, and stating that if not reinstated within x (probably 14) days, I will be issuing a money claim

    Assuming this does not provide a resolution, I would simply source a quotation and use that to value the money claim.  At the worst, if they contest you will be able to arbitrate.  At best, the claim will be issued and you can send the bailiffs in.

    If the police have yet to turn up, then that would certainly make sense (it's sensible advice anyway).
    Rewind the whole incident, and write it down in chronological order. Everything that happened and was said by each party from the moment you walked up to their door. As verbatim as possible. And how the remarks were made/delivered. Any change in mood or character. How it developed/escalated. Just everything, succinctly.
    Because I think you can anticipate a somewhat modified version from this guy.

    Update:

    I won't  comment about the assault except to say he has been interviewed and victim support have informed me that the police consider there to be enough evidence to charge . It has been sent to the CPS for them to decide whether it goes to court.

    In the meantime, our solicitor sent him a letter requesting Nancy's solicitors details. He replied .

    I do not own the legal title to the property in question. I would suggest that you conduct a Land Registry search of the property if you haven't already.

    I cannot assist you as to whether the landowner has a solicitor representing them, this is entirely a matter for them.

    Finally, I do not wish to receive any further items of correspondence from your firm, which , at best, can be described as a fishing expedition. If you continue to write to me with regards this issue, then please rest assured , this matter will be taken up with the Law Society and with -------- Police.


    The property has well gone past a wash and brush up for selling,he has had his brother in law and his nephew [ who has his own plumbing business] both working there as well as himself and other contractors.


    There has been an elderly couple visiting very regularly and we think that they are buying the place, it isn't going through an estate agent as it would have shown up on rightmove. 


    The solicitor is hoping to find out if a PoA has been actioned and by whom , we think it's his wife. So now we wait again.


    Hubby and I are at a loss what else we can do?

    Victim Support phoned before and she confirmed that it had been sent to CPS on 17th. I mentioned about all the extra stuff regarding the fence and the police regarding it as 'civil' and that if they do charge it may be possible to add criminal damage onto the charge?

    I did also mention about the totally secrecy involved on his side and that the solicitor regarded his reply as 'funny' and not in the ha ha way.

    I have sent an email to the PCI that's dealing with the assault, asking for an update. We were wondering whether when she does reply to attach the 2 letters . The solicitors to him and the reply, saying he's totally stonewalling and the solicitor and we think that there may be some sort of underhand dealings going on?
