    It's a judgement I'm afraid and I haven't moved house recently
    So if both the court and the claimant had your correct address, can you think of any reason why you didn't get a court claim at your current address?

    Is the keeper's address on your vehicle's Registration Document(V5c) up to date?

    Maybe speak to the CCBC on Tuesday and ask them for the address that they sent the County Court Claim.

    You should also SAR the solicitors so that they are obliged to give a copy of all correspondence and data they have on you.

    Here is a sample SAR template you can send them. If you think there may also be correspondence or other data about you that NCP has and you don't know about, SAR them too.

    Could this be another case of the claim form gone missing during the postal strike? We have had a couple of those resulting in no defence being submitted and a default win for the PPC. Ask for the date it was sent as well.

    Having interrogated my wife she's just unearthed a letter from BW Legal informing me that proceedings have been issued against me by NCP. I guess the most likely explanation is that the court claim was sent but has gone astray in here somewhere. With 4 children, a wife who's away with the fairies and an aged parent in the house that's the most likeley explanation.

    I'll just have to pay it. I can't see any way to get it set asaide now

    You can get it set aside if the claim form didn't turn up at all. Your word against theirs but I've also heard from another contact this week that the same thing has just  happened to them. 

    I do suspect a problem at the CCBC.

    Would not the fact that BW legal informed me that a claim was going to be made against me count in their favour though?

    Probably. Sadly that could be used against your argument.  It would be up to the Judge (on their discretion, so it IS risky) and unfortunately in your case you have already demonstrated on the balance of probabilities that post that IS served (arrives at your house) can easily become lost or ignored.

    The fee for set aside with a hearing is £275.
