Section 75 Rejection

  • Originally I just wanted the faults to be fixed and followed the advice from the broker, the dealership and the manufacturer. I only went down the Section 75 route when it transpired that the faults were never going to get fixed and no one wanted to take responsibility, and that is when I hit the latest issue. Now I'm just frustrated and angry about the whole affair :-(

    Your annoyance and frustration is clear and understood, but what do you wish to secure now?

    How much emotional energy are you willing to expend on reaching the outcome you desire?

    This situation should very probably never have arrived, but it is has.  Any kind of remedy is either going to be slow (pursuing the repair) or partial as any rejection will take into account your five years beneficial use of the car.
    You may be able to reach much the same outcome by selling the car and moving on. 
    It does sound as though your satisfaction with this car will never be high even if all the faults were fixed, as if by magic.

    If you now sell the car, what loss will you have suffered?

    For a piece of legislation S75 is actually relatively straight forward but it was written in 1974 when the whole credit market was totally different and whilst there have been small tweaks over time its been updating the limits/floors and not considering global market places, fintech companies etc.

    Ultimately S75 only duplicated your rights to the creditor (in certain circumstances) and so even if S75 has been disabled by breaking the D-C-S chain that doesn't mean you haven't lost your rights against the companies which you contracted with. assuming the broker and/or supplier still exist there is nothing stopping your pursuing your claim against them

    There was never a resolution. I was asked to keep monitoring the issues which I did. When I fed the info back to them, they did nothing.
