Manchester Central Car Park - UCKPS PCN

Hi Guys

My first time posting here. First of all I just wanted to discuss a recent win I had using this forum. 3 PCN's from Highview Parking Ltd/DCB Legal from 2018, all on the same car park. They wanted £800 from me and I received a letter of claim etc. and went to the telephone hearing.

I wrote my defence using the template provided and my main points was terrible placement of signage, included pictures from 2018 using google images and 2022 that I had taken myself. They had even changed the location/positioning of the signage in 2022 compared to 2018, most likely because they knew how bad it was. I also noticed this in my defence.

They didn't even show up to the hearing, the judge struck it out straight away. Less than 2 minutes. ANOTHER ONE BITES THE DUST. Thanks for all the good information and help on here guys.

But - I've got a new problem. Recently received another 3 PCN's from UKCPS from parking in Manchester City Centre. I parked there on the Friday 29th July and paid for a full days parking. Unfortunately I lost my car keys and was not able to collect my car until Tuesday 2nd August - I've received a PCN for the 30th July, 1st Aug and 2nd Aug.

I had PCN's stuck to my windscreen but i just discarded them, i refuse to give these guys the time of day. However now that I've been through the effort of writing defence etc. for the 2018 PCN's i'd rather nip these ones in the bud straight away.

I've received 3 notice to keepers through the post for each day recently, with it stating a response is required in 28 days - the fines are now all at £100 each. Whats the best thing to do at this stage? Complain?

Thanks for any help guys.

You can't nip UKCPS in the bud unless you can get the landowner to cancel these PCNs.  UKCPS are useless greedy ex-clampers who are not litigious so they won't agree to your appeal but are generally ignorable.

I'd just send an appeal with evidence of the loss of car key (effectively a vehicular breakdown) and send the same to the landowner by way of complaint.

    Unlikely to work.

    BUT DO NOT TRY IAS.

IGNORE UKCPS after that. Keep all letters and proof of trying to resolve the dispute, because it looks better to a Judge later (just in case).
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

  • Thanks Coupon-mad  I will give that a try.

Just thinking out loud here - on the PCN's all 3 pictures of my car is just the license plate, front bumper and the floor. No way of telling where it actually is. Is this actually sufficient evidence on their part?

    Cheers

It is sufficient evidence for them and their trade association.
Whether it is sufficient evidence for anyone else is a moot point unless it ever gets put in front of a judge.

As advised by C-m, Plan A is always a complaint to the landowner and your MP. If that fails, then appeal each PCN separately, citing frustration of contract due to the vehicle keys being lost.
