Last year I received a letter from a friend who lives at my old address , stating I had been issued with a ccj , which I payed immediately as it was within the month of issue .
I then informed DVLA of my change of address as I didn't want any more letters of such going to my old address .
It's been almost a year and I've just been given these two letters , which went to my parents house , my old previous address . However I don't often see my parents and realise it's too late to pay to prevent the CCJ remaining on file .
What I can say is that the one I got last year went to my old address , which the car at the time was registered too , and this recent one went to my parents , which that can and my driving licence had been registered. Until last year when I changed address on log booke and driving license.
So where do I stand with regards to this company not updating there records , and myself not receiving these in due time to do anything about it .
I guess after reading certain posts , that a set as
it seems to be the only way forward .
Thanks for taking the time to read ..

Yes, set aside.
A good recent thread that covers everything you need to do - including a skeleton argument and 4 authorities (case law to argue that an unserved claim is DEAD and can't continue) plus a link to the BPA Code of Practice - is by @BrokenchiefPRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Hi and thanks for the info .
What do you mean by the case is dead ?
Do you mean my case is dead ?
Kind regards

No, it means that a case should be considered dead by the courts if it has not been served on the defendant by the claimant after four months or more has elapsed.

So in my case , does this mean its been more than 4 months , I know the ticket is more than that , but uncertain of the time being served etc ?.Fruitcake said:No, it means that a case should be considered dead by the courts if it has not been served on the defendant by the claimant after four months or more has elapsed.

You need to progress the set aside process to get rid of the CCJ. Paying it will not remove it from your record. As the PPC fail to serve it at your correct address this should be a mandatory set aside. You have not provided any information on what the PCN was actually for and would normally then have to defend the claim or convince a judge you had a reasonable prospect of defending. However if you follow the process from Brokenwood you will argue as it is over 4 months since the claim was submitted to the court their claim should now be classed as dead.If you haven’t got any other paperwork contact the CCBC to get details and dates of the claim.3

Given the default judgment is dated 6th June, the claim was obviously improperly served in early May.
Find out when and which address it went to (by ringing the CCBC) and your application goes into the CCBC on the dot of 4 months.
All of this is already explained on Brokenchief's thread.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
