DCB Legal - CCJ after a forgotten PCN

Hi there

Just reaching out for advice after a letter we have had.
This PCN was for my cousin who works on the trains, parking up on double red lines to help, due to a suicide attempt on the rails

The PCN, I think, was by a private firm called First Parking and was ignored.

After years of ignoring my cousin replies with an appeal. As soon as she has appealed and ignoring again, they have now sent a CCJ.
It was perhaps foolish on her part to listen to people saying ignore.

As time is of the essence is there anything we can do about this?

Thanks

Have they really sent a CCJ - a  County Court Judgment - or has she perhaps received a County Court Claim Form?
  • There was a County Court Claim Form sent on 11/08 which she stupidly ignored
22/08 they have sent what I think is a CCJ

Opening lines read - “We have written previously in relation to the above matter and you should already be aware a county court judgement has been entered against you on 11/08 for the some of £245.00 due to non payment of previous debt.

Anything we can do with this?

Seems ridiculous that all this was to aid someone who’s life was at risk!

    Any help greatly appreciated.

    Thanks

If the Issue Date on the County Court Claim Form is 11th August, then a Judgment cannot have been made before Wednesday of this week - 31st August.

So a letter a stating "a county court judgment has been entered against you on 11th August" is somewhat premature - indeed, that is exactly the same date as you say the Claim was Issued.

Something is not quite right here. Are you sure that letter is about the same Claim?

Who has sent that letter? Who are 'they'?

And it seems equally ridiculous that the PCN recipient, not only didn't explain that, but ignored the PCN.

Sorry, I'm not taking sides here, but how on earth does anyone know the situation if no-one tells them?
  • I’ll attach some images hopefully they will help

You have now shown us a Claim Form with an Issue Date of 18th July 2022.

It clearly states on the back of that Claim Form exactly when responses are needed.

The Claimant was free to seek a Default Judgment on 8th August if the Claim wasn't responded to, and that seems to be what has happened.

I can't see that the Defendant has any other option other than pay that £245.25 being demanded, but wait for others to comment.

If DCB Legal are paid promptly, there will be no lasting Judgment on her credit file.

You might also want to remove those images you have shown us.
They all clearly show Danielle's full name and address.

I agree. She will have to pay it. Immediately and in full by phoning DCBLegal or scanning the QR code.

You can't ignore a court claim.  Very sad, as it would have been so easy to defend.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
