Parking ticket Advice
Please help - I received a parking ticket from parking eye. I arrived in the parking at 8pm and the parking machines were not working checked for alternative ways for paking and there was none other than paying through the phone or paybyphone app. I did not have my bank card and my mobile was suspended went to the restaurant nearby and got connected to their wifi and by the time I downloaded the app etc it was 840pm. I paid for 2hours and left the care park at 1040pm. I have the invoice for payment on the app. I have the photos of the machine showing it was out of order. There were no signs to say do not park if you have not found alternative ways of paying.
Please help, do I have a reason to appeal or just pay the £60 increasing to £100 on the 2/8/22

Why did it take 40 minutes to download the app? I have put many apps on my phone recently knowing I was going to be spending a few days in an area that was rife with "pay-bys" and it didn't take that long, however did sometimes take some time for the log-in process and the add car, add debit card and then actually pay! If that is what happened your appeal (which will no doubt be rejected) would be failure of the PPC's own equipment over which you have no control.3

Was this a general car park open to the public or one linked to a retail outlet. Often PE parking conditions restrict parking to the hours of opening of the retail outlet - and 8:00pm is often the 'witching hour'.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

Hi Thank you for your help, I decided to just pay as I realised it maybe fighting a losing battle due to the 40minutes past before I paid. It seems there is no common sense with these parking companies. Thanks0

You hardly gave us the opportunity to help you, and if you've actually paid £100, there would have been lots of time available to us to see what we could do - there was no prospect of that amount increasing, not until/unless a court claim is raised, and especially with PE of late, the prospect of that has much diminished.Lawpmany0204 said:Hi Thank you for your help, I decided to just pay as I realised it maybe fighting a losing battle due to the 40minutes past before I paid. Another way of putting it:
By paying, a person is sponsoring and funding the parking scam against the next few people, so the PPC can go after more parking charge victims going forward.
We are passionate about stopping the worst practices. As the only Consumer individual co-opted into the official Steering Group about the Parking Code of Practice Act, I've been attending Government meetings in my own time since May 2020 to get the law change through and new statutory code of practice to where it almost is now. I get no expenses and each meeting has been between 1 and 4 hours each time.
During that period I also had a full time supervisory job (I don't now, but I did). That'll be FOUR YEARS of my life dedicated to this new Code in the end, because its implementation is now delayed till 2024.
Guess whose money funded the two Judicial Reviews that bullied the Government and stopped the Code from progressing?
Yep. Victims who were sadly duped, or decided it wasn't worth their time, and who paid a scam PCN despite it being easy to fight and an empowering life experience.
Ordinary motorists sadly paid for the two Judicial Reviews and by doing so, they stopped the statutory Code of Practice and have delayed and jeopardised it.People who paid, funded that. Motorists' money stopped the new Regulation.
Ordinary motorists paid for a top ParkingEye employee to prat around like a celeb in a £160k McLaren supercar and park it sideways across 3 bays, because he/she can because no rules apply to them in their car park:

Still want to line their pockets? Or are we too late to convince you not to support and actively fund the scam?PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
